Abstract

\n\n
Problem statement. International relations in the field of solving environmental problems, and in particular the problem of climate change, are characterized by the use of a variety of instruments, and tools, covering both traditional sources of international law (the so-called hard law) and non-legally binding force (soft law). The complexity of climate change management, its fragmentation and decentralization necessitate the search for flexible means and methods for its implementation. Therefore, the definition of the features of the legal nature and the role of political agreements as elements of environmental diplomacy is of both theoretical and practical importance. The article purpose to determine the impact of informal agreements and other sources of soft law on the regulation of relations in the field of environmental protection, in particular their role in climate diplomacy. Methods. To achieve the goal of the study, a set of general scientific and special research methods was used. The formal-legal method was used to analyze the content of international acts on climate protection used in diplomatic practice; the comparative law method – was to clarify the peculiarities of the use of soft law and traditional international treaties to regulate cooperation between states in the field of climate change; method of system analysis – to identify internal links between the rules of informal agreements and formal sources of international law in the field of climate protection. Results. It has been found that while formal rules are important features of modern global governance, in some situations informal practices may repeal, replace or supplement formal provisions. This is especially evident in the cooperation of states in the field of environmental protection. Conclusions. The interaction of states outside traditional international organizations through informal agreements and other policy instruments provides a basis for a flexible response to new development challenges and allows solutions to problems that cover many different areas.
