The Departments of Public Law and International Law of the Universite Libre de Bruxelles organized this colloquium dealing with recognition of the status of political refugees and the granting of asylum. A decade after the beginning of what is commonly called the 'asylum crisis', it was an opportunity for the participants to take stock of these two important questions in refugee law. Gynaecology, forced sterilisation, and asylum in the USA

This chapter charts domestic proceedings in relation to the Commonwealth’s powers to regulate migration. It examines the human rights framework in Australia, noting that there are few limits on Parliament’s ability to enact legislation that is inconsistent with Australia’s international obligations, and maps the long history of judicial review of decisions under the Migration Act 1958 (Cth). Administrative decision-making is also addressed, with an eye to seminal early cases in the Administrative Appeals Tribunal (AAT) that featured review of exercises of power under the Migration Act; the recent amalgamation of the sui generis Migration and Refugee Review Tribunals into the AAT; and the establishment of a new ‘fast-track’ mechanism for reviewing certain asylum applications. The chapter also discusses Parliamentary efforts to limit judicial consideration of Australia’s international obligations in the process of statutory interpretation, and to restrict judicial review. It examines the courts’ responses to these developments, particularly with respect to incursions on core judicial functions, and proffers some conclusions on the ultimate strength of judicial and administrative remedies under Australian law in migration and refugee cases.

Same-sex relationships have successively qualified for formalization through marriage or registered partnership in many European countries. However, some EU Member States still refuse to give them any form of recognition or only allow very limited legal effects. The irregular speed of development in domestic family laws in EU Member States results in 'limping family' relations, that is, family relations that are recognised as creating a formal civil status in many EU Member States, but not in all of them. The <i>ordre public</i> safeguard of private international law has widely been used to justify why a same-sex marriage or registered partnership cannot be recognised. The pretext tends to be that national identity, allegedly, becomes threatened. Nevertheless, the case-law of the European Court of Human Rights and the Court of Justice of European Union provides new standards for recognition, which create legal obligations for EU Member States.
