Intellectual Property and Consumer Law in the Knowledge Economy
Abstract The coronavirus pandemic, which first began in December 2019, has completely changed our daily lives. In particular, daily online digital content consumption over the world has soared since the start of the coronavirus pandemic. For preventing illegal digital content distribution, various technologies have been applied, but current copyright protection technologies are still lacking to provide secure digital content distribution while preserving privacy. In this article, we introduce a new digital content distribution system, which utilizes blockchain‐based decentralized identifier and format‐preserving encryption to enable user privacy preserved digital content tracking. We present the system architecture with detailed message flows of the proposal and provide its analysis result in terms of security and overhead.

Research on Secure Digital Content Distribution for Peer to Peer E-commerce Applications
To resolve network congestion and other problems in electronic commerce (e-commerce) applications, such as digital content distribution in e-commerce, the e-commerce applications distributed systems based on the traditional paradigm are nowadays replaced by peer-to-peer (P2P) systems. Peer to peer technology has a lot of advantages for e-commerce applications especially in digital content distribution field. For commerce applications, the security and P2P rights management become more and more urgent. New schemas and solutions for P2P e-commerce applications' security and right management, which are expected to function automatically or semi-automatically, should be proposed. In this paper, a secure digital content distribution scheme is presented, which can trace illegal distributors in Peer to Peer e-commerce applications. In this scheme, the encrypted content is decrypted into different copy under the control of a fingerprint and encryption key at the peer side. Thus, each decrypted media copy contains unique information that identifies the peer. For the decryption operation and fingerprint embedding operation are combined together, which avoids the leakage of clear media content. Additionally, these operations are implemented by the peer, which makes the scheme compliant with existing Peer to Peer Digital Rights Management (DRM) systems and very proper for P2P digital content distribution e-commerce applications, performance evaluation is also included.
Read moreThe production and distribution of digital content in China. An historical account of the role of internet companies and videogames
PurposeThis paper aims to shed some light on the history of the Chinese videogames industry, to document the growth of the leading companies and reveal how they have been morphing into platforms delivering constellations of apps and digital content (audiovisual, films, music, literature, video streaming […]). The paper tracks the development of digital services through the prism of videogames thereby showing how this industry emerged out of the deployment of the internet.Design/methodology/approachThe paper provides an overview and a synthesis of what is known about the Chinese game industry, particularly based on consultancy documents and publications from firms. The paper is based on desk research, a review of literature and trade press and the analysis of the annual reports of the leading players (NetEase, Tencent […]).FindingsThe rise of videogames and the creation of specific company’s “ecosystems” illustrate the capacity of the industry to innovate and its significance for the Chinese economy. It reveals that gaming has been a cornerstone of many Chinese technology companies. The (young) companies came up with the innovative business models (FTP, virtual items) that were required to further expand the market. They found new ways to interact with their customers through communities and various tools.Research limitations/implicationsThe paper relies on consultancy documents and publications from firms on heterogeneous data from industry and consultants. This approach comes with some limitations from a methodological viewpoint. It allows documenting the historical trends and describing the industrial landscape but not to qualify the relationships among players. Besides, the use of these sources leads to a greater focus on business models and a more limited one on the policy dimension. The latter is often perceived only through the glasses of the companies.Practical implicationsThe data provided are meant to be useful to become familiar with the Chinese games industry.Social implicationsThe paper indicates that the online game industry is a complex web of activities with tensions and contradictions between stakeholders (industry, government and consumers). In the case of China, there is a conflict between the willingness to liberalize the economy and the will to maintain an ideological monopoly through cultural industries.Originality/valueLittle research has been devoted to the role of videogames in emerging economies, to its specific features and to the relationships with the media industry and the information and communications technology sector. The contribution of this “digital native” to the production and distribution of digital content remains less studied. The paper provides an up-to-date overview of the Chinese case.
Read moreOptimal Digital Content Distribution Strategy in the Presence of the Consumer-to-Consumer Channel
Although the online business-to-consumer (B2C) channel is the primary selling channel for digital content (e.g., videos, images, and music), modern digital technology has made possible the legal dissemination of such content over the consumer-to-consumer (C2C) channel through personal computing devices, such as PCs, mobile phones, and portable media players. This paper investigates the optimal channel structure and the corresponding pricing and service strategies for digital content distribution in order to understand the business value of introducing the C2C channel alongside the prevailing B2C channel. We identify conditions under which it is more profitable to use both B2C and C2C channels simultaneously (i.e., the dual-channel distribution). In such cases, the seller performs price discrimination among consumers but provides them with a higher level of service. Our analysis further characterizes the benefits of service provision. We show that service provision can increase the dual-channel pricing flexibility, reduce the seller's B2C channel dependence, and allow the seller to tolerate higher C2C channel redistribution costs. Finally, in examining the effect of a competitively determined B2C channel price on optimal channel strategy, we find that the seller prefers a dual-channel distribution under higher B2C channel prices.

The digital content distribution businesses satisfy people's requirements for the rich and colorful digital content and also promote the user experience. These businesses also make an increasing profit for content makers, content providers and network carrier, and will be a critical position in the future business value chain. However, copyright piracy still doesn't solve very well and results in great loss for content providers. The digital content has the characteristics of easy copy and distribution, therefore, digital rights management has been the key technology to protect intellectual property of digital contents, control their dissemination and usage in digital content Web issue. First, synthetically analyze the disadvantages of typical digital rights management framework. Second, given a series of the problems in the modern system, digital rights management system based on smart card is proposed. Making use of the characteristic of smart card itself, the new framework will be mobile, secure and off-line. Following this, a set of digital management protocols are designed, including license acquisition protocol, usage, update protocol and authentication. The new system's framework, module structure, system design and realization are described. At last, the new system's characteristic is analyzed and is proved to be secure and efficiency.

Under the background of the digital era, the self-media platform breaks the information barriers between the communicators and the receivers, effectively alleviating the information asymmetry problem between the two.Through observation and research, this paper finds that the current channels for receivers to obtain digital information can be divided into user-generated content (UGC), professional-generated content (PGC), and brand-generated content (BGC) according to the classification of the main body, but most of the managers are negligent in the management of these digital contents, and do not really utilize the value of their dissemination.Digital content generation and dissemination based on natural language processing (NLP) technology has become an important way to solve this problem. The method is based on the unified processing of a large amount of corpus, input Word2vec model and Skip-gram model two types of language models for training, with the obtained language model for the required text can be obtained word vectors, the different lengths of the text will be unified vectorization.By introducing evaluation indexes such as dissemination efficiency, content quality and coverage, the effect of generated content can be measured objectively. The value of generating digital content to improve the dissemination efficiency is verified through the evaluation of the actual effect.
Read moreSTOP, You’re on Camera: The Evidentiary Admissibility and Probative Value of Digital Records in Europe
Under the rule of law, the punishment of an accused is possible only when his or her guilt is proven before the judiciary in accordance with legal safeguards including the rules of evidence law. Digital community policing systems—mobile device policing applications and associated networks and servers—collect, transmit and store digital records relevant to violations of law, which can be used by law enforcement agencies as tips to collect further evidence and by prosecutors to prove the guilt of the accused. These digital records must meet the law requirements with regard to the admissibility and probative value of evidence: relevance, legality, authenticity and reliability. Therefore, digital community policing systems should have measures that: (1) enable the identification of the source of the digital records and the time, date and location of their creation; (2) protect the digital records from alteration, manipulation or damage during the collection, transmission or storage; (3) ensure that the digital records are what they purport to be and (4) verify whether the digital records have suffered any omissions.

Read moreThe Present and Future of Digital Rights Management
Over the last few years, Digital Rights Management (DRM) systems have become increasingly successful in various areas of digital content production and distribution. While DRM-related technology research has achieved a certain degree of maturity since the 1990s, the legal framework surrounding DRM systems remains in flux and is fiercely debated. This keynote speech first provides an overview of the various ways by which digital content is protected in a DRM system. The intertwining protection by technology, contracts, technology licenses and anti-circumvention regulations may lead to a new property right making copyright protection obsolete. However, there is a danger of over-protection: questions of fair use and other limitations to traditional copyright law have to be addressed. If competition is not able to solve this tension between the interests of content providers and the interests of users or the society at large -- which seems doubtful at least -- it is the law that has to provide a solution. The speech presents the different approaches legislatures in Europe and in the United States have adopted. Second, the speech discusses recent developments at the intersection of DRM and the law, in particular the discussions about DRM interoperability, patents on DRM technology, DRM standards, and the relationship between DRM and levy systems as well as between DRM and trusted computing. Third, the speech analyzes recent scholarship that attempts to solve legal and policy questions surrounding DRM on a technological level. The speech questions whether the tension between technological protection and public values such as fair use, privacy, competition and an innovation commons is really irreconcilable. It argues for a more nuanced approach that explores possibilities and limitations of a value-centered technology design of DRM systems. Only if technology research focuses on such questions, the disapproval of DRM systems by many legal scholars and policy activists could possibly diminish in the long term.
Read moreThe implementation of digital marketing communication strategy in cultural tourism: a case study in Yogyakarta
Cultural tourism is one category that attracts local and foreign tourists. Various previous studies have shown that digital marketing communication media plays an essential role in influencing tourist interest in visiting tourist destinations. This study aims to analyze the implementation of digital marketing communication strategies in marketing cultural tourism with a case study of cultural tourism destinations in Yogyakarta. This study uses a case study method with indepth interviews and field observations as data collection methods. The collected data were analyzed using thematic analysis and SWOT analysis. The results showed that managers of cultural tourism destinations optimize social media such as Facebook and Instagram for promotion. Whatsapp and email are also used for more personal communication with customers. The company's systematic digital marketing communications planning system supports solid work teams and produces original content. In addition, the extensive national and international marketing network and stable institutional position, because it is a stateowned company, are the advantages of this company. The increasing public interest at home and abroad for travel, the reduced Covid-19 pandemic, and the availability of various digital promotional media are opportunities for this company. However, the technical competence of staff in managing digital marketing media still needs to be improved. In addition, the digital content production and distribution scheduling system has not been implemented strictly and consistently. The quantity and quality of digital media content are also still limited. In addition, this cultural tourism object has several external challenges, such as the emergence of various new tourist objects in Yogyakarta, which are more aggressively promoted through digital media, and the possibility of a re-emergence of the Covid-19 pandemic or other natural disasters. This paper contributes to the literature on digital marketing communications by focusing on its implementation in the context of cultural tourism.

Read moreTriggering the emergence of digital ecosystems: the role of mobile and video games in emerging economies
PurposeThis paper aims to shed some light on the role of video games within the media industry and IT sector, on its contribution to the production and distribution of digital content in emerging economies. It offers a case study on the role of mobile devices as a factor of transformation and shows how under changing socio–economic conditions, the transformations enabled the creation of digital ecosystems and innovative business models.Design/methodology/approachThe paper is based on desk research, a review of literature and trade press and comments from experts and industry players.FindingsThe paper argues that as the internet is going mobile, driven by data – mostly video – the new mobile platforms are becoming the key for the distribution of content and mobile games. Whether it is the history of browser games in China, mobile games in India or PC games in Russia, each national gaming industry has required a unique strategy for making money, building on some prominent cultural factors and adapting to the local economic conditions. The paper reveals that video games are now clearly a vital part of digital content production in these countries, while stressing upon the role of public policies.Research limitations/implicationsThe paper relies mostly on industry and consultancy data, as in such a fast-changing environment official data even when accessible are in most cases too old to remain relevant to identify the trends and the fast changing stakes. This calls for some caution about the data. Therefore, the data used should be treated as just signals of potential trends, sufficient to provide an appropriate overview of the evolution of the global mobile ecosystem.Practical implicationsThis paper shows that the video games industry can serve as a pivot for the ICT industry. Besides, this prompts upstream and downstream industries of the entire digital entertainment market to thrive.Social implicationsThe paper shows that companies from emerging markets companies have been betting on a combination of factors: the development of the economies, the growth of the mobile market, emerging middle-classes and young customers. It provides a growth model that appears to be close to a “regular” industrial growth model.Originality/valueAlthough there is a growing academic literature on the video games industry, few research have been devoted to specific issues of emerging economies and to the role of video games within the media industry and IT sector.
