Abstract

Abstract This chapter explores functional equivalents to guarantees within the unfunded credit protection framework, focusing on instruments such as credit risk insurance and risk participations. It demonstrates how regulators, particularly in the UK and EU, recognize these instruments as equivalent to guarantees when they meet specific operational criteria. Through historical and legislative evidence, the chapter establishes regulatory acceptance of these instruments, tracing their evolution from the Basel Accords to their implementation in the EU and UK. It analyses challenges like reconciling insurance-specific exclusions with guarantee-based eligibility requirements, highlighting the need for tailored regulatory approaches. The chapter also explores the use and recognition of credit derivatives and credit default swaps (CDSs). The chapter underscores the importance of bridging legal classifications and practical applications to ensure compliance and functionality in the evolving financial landscape.
