The study examines the patrimonial responsibility of the Public Administration in non-higher education teaching centers during the development of extracurricular and complementary activities. After the amendment of the Civil Code of 1991, there is a transfer of responsibility from the teacher to the holders of non-university teaching centers for crimes or misdemeanors incurred by students under the age of eighteen during the periods in which they are under the control or supervision of the faculty in the center (during school activities, extracurricular or complementary activities); therefore, the articulation of that responsibility of the owners of the centers for the culpable or negligent actions from their agents will be studied. To do this, we review the responsibility of the teacher through the study of significant sentences, from which it is concluded that the motivating principle of this responsibility is the guilt. We will study the imputability of the damage to the Public Administration based on a normal or unusual operation of the service and we will analyze, after the study of certain Supreme Court decisions, cases in which it is considered that the diligence of a householder has not been used for the prevention of the damage (physical or psychic).

Despite having explained normatively and conceptually what should be a year-long plan, the reality shows that, in some cases, its treatment by the faculty can improve. Teachers notice a big difference between the curriculum ordered from the Educational Administrations, what they plan in their plan, and what is developed daily with the students in their classroom. Based on the idea of the contextualized design of the institutional center’s documents should be the starting point for the improvement of teaching and learning processes, this article shows a guide that tries to help teachers to develop the basics that should appear in each of the sections of a year-long plan. In any case, the Education Administrations should consider the opportunity to break with the structure of the current year-long plans, and link their design to an interdisciplinary treatment that helps the achievement of the key competences and the objectives outlined in the different educational stages.

In spite of the changes to education norms in our country in the last ten years, where we have tried to integrate the different curriculum components in teaching and learning design, it is still typical to detect (1) curriculum plans that encourage rote learning and (2) teachers that continue teaching in the same style in which they were taught as students, and/or simply copying the textbook, even though sometimes it doesn´t provide the appropriate teaching and reliable assessment which meets the needs of our society. The insufficient academic training of (1) teachers, superintendents, and education authority members and (2) staff assessment that assures the best teaching practices in the classrooms, may be contributing to the inability to improve our education system. With respect to these deficiencies, we may come to the conclusion that the inclusion of these competencies in the curriculum and evaluation is a superficial action to fullfill European education requirements, more than a real plan to improve teaching and learning processes, and therefore, learning results in our country.
