This article responds to the tension inherent in the Constitution of the Republic of South Africa 1996 which lists ‘the environment’ proper as a function of national and provincial government. The authors discuss one of the arguments raised in the recently decided case of Marius Nel and Others v Hessequa Local Municipality and Others (2015) with particular emphasis on what the court’s reasoning adds to the growing body of jurisprudence on local government’s authority to govern environmental matters and the need for cooperative environmental governance in the South African context. The article features an overview of the relevant facts and findings in the Hessequa case, followed by a discussion of the implications of the court’s judgment.

The article examines women’s local government representation following amalgamation to form a super-sized city authority, Auckland, which covers a third of New Zealand’s population. Using a gender perspective, it analyses the promise implicit in amalgamation rhetoric that democratic gaps in representation, including the gender gap, would diminish. It examines the question of whether size has made a difference. Prior to local government amalgamation, women’s representation had not significantly increased over a period of seven election cycles. Women’s descriptive and substantive representation are examined at national and city levels and the gendered implications of local government reform are considered from the perspectives of female elected representatives at councillor and local board levels. Evidence shows that local government reform has yet to be the catalyst for improving women’s descriptive and substantive representation, although there are tentative signs of entry-level improvement at community board level which raise the prospect of a pipeline effect. Interviews with elected female representatives after amalgamation show that while they do not identify themselves as speaking for women, they see themselves as women speaking for their communities and doing it better than men. The results suggest the influence of gender backlash politics and also confirm the need to think about the performance of elected women as more than ‘articulated’ representation.

Over the last two decades a feature of local government reforms globally has been the introduction of New Public Management (NPM). Under this broad approach to public administration there is an expectation that councillors play a greater strategic role and move away from involvement in day-to-day management. This research, carried out in the state of Victoria, Australia, examines councillors’ understandings of their roles. Based on 17 in-depth interviews and two focus groups, we found that despite the evolving legislative requirements framing councillors as policymakers not managers, most councillors continued to seek involvement in the day-to-day management of councils. We argue that this gap may be linked to the diversity of views concerning the role of the councillor and the idea of representation and how both play out at the local level. It may also signal a lack of awareness as to how the legislatively inscribed role for councillors has changed over time.

Academic books emerge in a variety of ways. Some are the result of pure serendipity. For instance, in February 2011 Brian Dollery and I were completing a report that delved into the conceptual and theoretical foundations of shared services. Brian had also co-authored several case studies of shared services in Australian local government over the years, some of which I had contributed to.

This study seeks to assess the determinants of property rates default in the Ashanti Region of Ghana. A multi-stage sampling technique was used to study 540 respondents from one municipal and five district assemblies within the region. A structured questionnaire collected data from the sampled respondents. Descriptive statistics (means, frequency distribution and percentages) and the probit regression model were then used to analyse the data with the help of SPSS and STATA respectively. The study found that most respondents who default are not aware of their obligation to pay property rates, and those who are aware fail to pay because they don’t know where to go to pay, or think the rate is too high. The study also revealed that a demographic characteristic such as income level, property value and property location influences rates of default. The study recommends raising awareness about the need to pay property rates and the penalty for any default.

The paper examines the impact of public accountability mechanisms in the Uganda's decentralisation local governments. Some of the common tools used for evaluation of local government performance have been presented and discussed including the baraza, village participatory democracy and the score-card reporting method. The orthodox theories of local governance and concept of democracy are bases for assessing the feasibility of public accountability in Uganda. The conclusions of the paper points to inefficiencies are the universal applicability of the concept of local democracy leading to a suggestion of new mechanisms of public accountability that emerge from organisational learning.

The Uganda Constitution of 1995 spelt out the principle of decentralization by devolution. Accordingly, from 1995 to 2005, district local governments had a dejure mandate to hire and fire all categories of civil servants through their respective district service commissions (DSCs). Following the Constitutional amendment in September 2005, the right to hire and fire district chief administrative officers (CAOs) reverted to central government. Critics of recentralization of CAO appointments contend that the shift in the policy and legislation for managing CAOs runs contrary to the principles of decentralization by devolution. This paper argues that recentralization of CAOs has confused reporting, reduced the autonomy of sub-national governments in civil service management, undermined accountability of CAOs to elected councils, and shifted the loyalty of CAOs from local governments with and for which they work to central government that appoints and deploys them. To deepen accountability in local governments, the paper advocates for decentralization of CAO appointments, but for participation of central government in recruitment of CAOs within the confines of a separate personnel system. It further calls for a rethinking of the current call by the 9th Parliament to recentralize human resource in health in local governments owing to accountability challenges of managing the civil service in sub-national governments under an integrated personnel system.

A complex process of global consultation is currently under way to discuss the shape of the MDGs Post 2015. The aim of this paper is to address the question of where Local Government (LG) should fit into this debate, as a modest contribution to the ongoing consultation process. The paper is structured as follows: the first section describes in more detail the global consultation process on the Post 2015 agenda; the second describes how Local Government relates to the current MDGs; the third section explores how some of the consultation documents see the role of LG before considering what the role of LG could be in the new agenda. The final section speculates on more radical roles for LG, in terms of what we should be asking for, and suggests new roles for LG in partnerships with other civil society organizations in poverty reduction.

Local government is purposely established by law to provide grassroots development. In federal states, it is usually created by law of the federating units, and in unitary states it is created by central government. However, since the entrenchment of local government as a third-tier level of government in the 1979/1999 federal constitutions of Nigeria, there have been a lot of difficulties in creating new local governments. This paper examines the dynamics of this structure and the challenges posed to the orderly creation of new local government areas in Nigeria. The paper adopts secondary methods of data collection and analysis. It finds that the conflicting constitutional provisions which vest in the state and federal governments powers to create new local government areas have created many controversies in the polity. It recommends that the creation and statutory finance of local government councils in Nigeria should be expunged from the federal constitution.

Local development, whether construed broadly as community development or more narrowly as local as economic development (LED) is not always associated with local government but rather is the purview of a central government department or agency in Anglophone Caribbean policy systems. However with the emergence of ‘local place - and people-oriented approaches’ to development that offer new propositions about how to respond to risks and opportunities brought by globalization, local government is seen increasingly as an appropriate institutional context in which to pursue short-range objectives, such as creation of market opportunities and redressing the disparities within national economies; as well as the long-range goal of social transformation. A developmental role for local government raises two questions that form the central concerns of this paper: What are the institutional and organisational imperatives of a developmental role for local government? To what extent have these imperatives been addressed in reform? A critical analysis of local government reform policies in Trinidad and Tobago and Jamaica revealed substantive convergence around local development as an outcome of reform but also important divergence in the approach to achieving this goal which suggests the absence of a cohesive model. The paper argues for a new agenda in reform that links local government more consistently with a local development strategy. It asserts that such a strategy must incorporate gender equality, the informal economy and institutional organisational capacity in the process of transformation and as a basis for creating a local context in which all types of resources can be maximized in the process of wealth creation in a locality.
