Studies in American Political Development (

Abstract This paper documents how administrative geography functioned as a strategic political instrument during post–Civil War Reconstruction. I document sixty-seven counties established by Republican-controlled state legislatures across the South that concentrated Republican and African American voters. Historical boundary data and election returns show that Republicans created new counties in areas where they held strong support, added legislative seats that strengthened their majorities, and expanded opportunities for African American political representation at the state and local level. This partisan model of administrative unit proliferation advances our understanding of institutional design during contested democratization. The findings contribute to research on American political development, democratization, redistricting, and administrative design politics—showing that county creation functioned not merely as administrative policy but as a tool in partisan competition with lasting consequences for American political geography.

Abstract We trace the origin of felony disenfranchisement from the colonial period through Reconstruction. On the eve of the Civil War, three-quarters of states had criminal disenfranchisement statutes. These laws were based on “legal moralism” principles, which limited the franchise to those in good standing with the community. Efforts at disenfranchisement grew as access to the ballot increased and criminal justice reforms replaced capital and corporal punishment for imprisonment. We highlight important transformations in felony disenfranchisement during Reconstruction, specifically in new state constitutions and the Thirteenth and Fourteenth Amendments. All but one Southern state included felon disenfranchisement in their new constitutions that the Republican-controlled Congress ratified for readmission to the United States. Radical Republicans in Congress and state legislatures were in most cases advocates of felony disenfranchisement to exclude former Confederates from political participation.

Abstract This article engages with scholars working on the history of capitalism and with scholars of American political development to form a historical materialist perspective on the creation of the American federal government. First, it returns to the debate about the state in capitalist society to develop an approach for theorizing the relations between class, capitalism, and states. Next, it addresses the position of American capitalism in the 1780s, arguing that it was still in a long transition phase. After this, it reinterprets the Constitutional Convention of 1787 in the context of the long and uneven history of American capitalist development. I argue that the U.S. Constitution created the foundations of a state that would serve capitalist interests, including capitalist slave owners, but, at the same time, provided some space for social relations of production not yet fully subordinated to the power of capitalism to coexist.

Abstract The end of the Civil War brought freedom to 3.9 million formerly enslaved people. Yet, almost immediately following the war, Southern states started to incarcerate freedpeople at unprecedented rates in an effort to reinstate racial hierarchies in the post-Emancipation era. Not before long, Southern states introduced new carceral institutions, most notably the convict-lease system, under which prisoners were leased out as laborers to private contractors for the duration of their sentence. The emergence of convict leasing has often been portrayed as a programmatic attempt by the Southern whites to find an alternative to antebellum chattel slavery.1 Paying special attention to the sequencing of political events during Reconstruction, I revisit this story by highlighting the role that state capacity and public finance played in the introduction of the policy. As conviction numbers swelled after Emancipation, the carceral capacity of Southern penitentiaries was quickly overwhelmed, prompting Reconstruction legislatures and governors to search for alternatives to conventional imprisonment. I argue that convict leasing emerged from these capacity challenges as a cost-effective solution that initially enjoyed broad bipartisan support. Over time, leasing grew more profitable, both for the state governments and the lessees, and abolition efforts were stalled for decades, even when the system became increasingly abusive. Using a range of archival materials, I illustrate these carceral developments in an in-depth case study of the origins of convict leasing in Georgia.

Abstract Researchers have long argued that an important impetus for the creation of the administrative state was the desire to bring experts into government and especially into the regulation of business. Yet Progressive Era politicians did not focus on attracting experts when crafting one part of the administrative state, independent regulatory commissions. This article examines the contemporary understanding of regulatory commissions and shows that they were most often intended as a substitute for vacillating juries. Commissions’ most important advantage over juries was that they acquired experience in investigations of a single subject over time, not that their appointees were already academics or experts in a particular subject. This article also shows that appointments to these commissions did not demonstrate a desire for apolitical expertise. This is the first examination of all members appointed to the Interstate Commerce Commission, Federal Trade Commission, Federal Power Commission, Federal Communications Commission, and the Securities and Exchange Commission in the period from 1887 to 1935. This article finds that political and sectional balance, rather than previous expertise, were the most important criteria for these commissions’ members, at least until the late 1920s, after the end of the supposed Progressive Era.

Abstract The policy feedback literature developed in an era in which the level of polarization and the intensity of party competition were far lower than today. These background conditions narrowed the scope of many policy debates and facilitated the consolidation of programmatic expansions after their enactment. As a result, the feedback literature emphasized the ways that new policies build supportive constituencies and become entrenched. While the core insight that policies can generate major political repercussions remains solid, American political development (APD) scholars should pay greater attention to the role of negative feedback processes and backlash politics in an era of disunity. Based on a review of New York Times articles mentioning policy backlash between 1960 and 2019, I show that the 2010s was a period of heightened countermobilization. Backlash forces have diffused from civil rights into many other arenas—including health, trade, and immigration—due to partisan polarization, conflicts over cultural shifts, and the negative feedback from activist government itself.

In the post-Reconstruction South, two Republican factions vied for control of state party organizations. The Black-and-Tans sought to keep the party inclusive and integrated, while the Lily-Whites worked to turn the GOP into a whites-only party. The Lily-Whites ultimately emerged victorious, as they took over most state parties by the early twentieth century. Yet no comprehensive data exist to measure how the conflict played out in each state. To fill this void, we present original data that track the racial composition of Republican National Convention delegations from the South between 1868 and 1952. We then use these data in a set of statistical analyses to show that, once disfranchising laws were put into place, the “whitening” of the GOP in the South led to a significant increase in the Republican Party's vote totals in the region. Overall, our results suggest that the Lily-White takeover of the Southern GOP was a necessary step in the Republican Party's reemergence—and eventual dominance—in the region during the second half of the twentieth century.
