Democracy as a Universal Value: United Nations Sources
Abstract The UN has propagated national democracy as a universal value, defined its essential human rights-based features and helped putting it into practice by election monitoring. It has emphasised that human rights, the rule of law and democracy are interlinked and mutually reinforcing. More recently, it has also promoted international democracy, including through UN reform. But in the UN sources there is no reference to any individual or collective general human right to national or international democracy which would be helpful at a time of democratic backsliding.

The General Court gives with one hand and takes away with the other Reflections on the judgment in <i>BAWAG PSK Bank v ECB</i> (T-667/21) concerning the ECB's mandate to apply national law
A decade ago, the European Central Bank (ECB) became the chief prudential supervisor of euro area's credit institutions. In order to carry out its supervisory tasks, the ECB is, inter alia, competent to apply national legislation transposing directives, including Capital Requirements Directive IV (CRD IV). The ECB is thus the first EU institution with a mandate to apply not only EU law but also national law. This has raised a number of practical and legal-constitutional questions, many of which remain to be answered. The BAWAG PSK v ECB judgment by the General Court offers some new important insights. In particular, it sheds some light on the scope of national law which the ECB is competent to apply, further clarifies the principles of judicial review of ECB decisions based on national law, and indicates the obligations of the ECB in case the national law which it intends to rely on or apply is in conflict with the directive which it (the national law) is supposed to transpose.

Die schweizerische Europapolitik steht auf dem Prüfstand. Der Bundesrat und die Europäische Kommission schlagen vor, die bestehenden Abkommen auf eine neue institutionelle Grundlage zu stellen und zusätzliche Abkommen abzuschliessen. Der damit einhergehende Integrationsschritt fordert das Staats- und Demokratieverständnis in der Schweiz heraus. Gleichzeitig ist das ausgehandelte Vertragspaket eine Voraussetzung für die Weiterführung des bilateralen Wegs. Andernfalls besteht die Gefahr, dass dieser Weg erodiert. Das wäre keine verlockende Perspektive – weder für die Schweiz noch für die EU. Höchste Zeit also, die rechtlichen Beziehungen der Schweiz zur EU näher kennenzulernen! Es zeigt sich, dass die Doppelstrategie der völkerrechtlichen Anbindung und der selbstgewählten Anpassung zu einer weitgehenden Integration der Schweiz in das Recht der EU geführt hat – deutlich weitgehender als dies einer breiten, auch juristisch fachkundigen Öffentlichkeit bewusst ist.

The war between Russia and Ukraine is generally interpreted from a culturalist perspective. However, the methodological nationalism inherent in such approaches is misleading. Anyone who wants to understand developments in Ukraine and the escalation of the conflict with Russia must view the events as a class conflict. Neither the political capitalists, often referred to as “oligarchs”, nor the urban middle class, associated with transnational capital, have managed to present the working class and the lower middle class with a convincing forward-looking project for Ukraine and thus achieve cultural hegemony. The constellation is the same as in Poland or Hungary, only the geopolitical environment is different. Russia, too, was characterised by this post-Soviet class conflict until Putin’s Caesarean model of rule prevailed. Russia’s ruling class has been attempting to extend this model to Ukraine since 2022.
