The Challenges of the French Judicial Map

The French judicial map is made up of several hierarchical territorial divisions: it is the degree of seriousness of the offense that determines the territorial division of the competent criminal jurisdiction. Therefore, the tripartite classification defined by the Penal Code is matched by three tiers of courts of first instance: the Court of Assizes for felonies, the Criminal Court for misdemeanors and the Police Court for misdemeanors. Although the debate on the primacy of equality and rationality may seem unchanging since the French Revolution, it has been at the root of significant developments in the search for an optimal network of courts to judge criminal offenses. The advent of post-revolutionary France brought new reflections on the essence of justice. A nationwide analysis of several million offenses and the convictions they entail provides the beginnings of a response to the consequences of territorial division.
